By accessing or using FastESTI ("the Service"), operated by Beige LLC, an Ohio limited liability company ("Company," "we," "us," or "our"), located at fastesti.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.
We reserve the right to modify these Terms at any time. Material changes will be communicated via email or in-app notice at least 30 days before taking effect. Your continued use after such notice constitutes acceptance.
Your use of the Service is also subject to our Privacy Policy, which is incorporated into these Terms by reference.
FastESTI is a software-as-a-service (SaaS) platform that provides AI-assisted construction cost estimating tools. The Service uses artificial intelligence to help contractors, builders, and construction professionals generate project estimates, manage clients, and create proposals. Features may change over time as we improve the platform.
The Service is provided for informational and workflow assistance purposes only. We do not guarantee cost savings, profitability, winning bids, increased revenue, or any specific business outcome from using the Service.
You must be at least 18 years old and have the legal capacity and authority to enter into these Terms. If you are using the Service on behalf of a business, you represent that you have authority to bind that business to these Terms.
You must provide accurate information and are responsible for maintaining account security. You are responsible for all activity under your account and must notify us immediately of unauthorized use at support@fastesti.com.
We are not liable for losses resulting from unauthorized account access.
Paid plans are billed on a recurring basis through Stripe. By subscribing, you authorize charges to your payment method.
We may offer free usage or trial access. Free trials may be modified or discontinued at any time without notice. Inactive trial accounts may be deleted after 90 days.

The Service uses artificial intelligence (including third-party providers such as Anthropic). You expressly acknowledge and agree that:
YOU ASSUME ALL RISK associated with reliance on AI-generated estimates. Beige LLC shall not be liable for any damages, losses, or costs arising from your use of or reliance on AI-generated content, including but not limited to:
When you upload documents (blueprints, plans, spreadsheets, images, etc.) to the Service, you represent and warrant that:
You retain ownership of your uploaded documents and generated estimates. We may process and store your data to operate and improve the Service.
You are responsible for maintaining your own backups. Beige LLC is not liable for data loss, corruption, deletion, or inaccessibility for any reason.
The Service, including its software, design, features, branding, trade names, logos, and documentation, is the property of Beige LLC and is protected by U.S. and international intellectual property laws. You may not copy, modify, distribute, sell, reverse-engineer, decompile, or create derivative works from any part of the Service without our written consent.
You retain ownership of all content you create using the Service. By using the Service, you grant Beige LLC a limited, non-exclusive, royalty-free license to process your data solely for the purpose of providing and improving the Service.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, RELIABILITY, RESULTS, AND NON-INFRINGEMENT.
WE DO NOT GUARANTEE UPTIME, AVAILABILITY, ERROR-FREE PERFORMANCE, OR SECURITY.
We may offer beta or experimental features which may be incomplete, contain errors, or be changed or removed at any time without notice. Use of beta features is at your own risk.
NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY BEIGE LLC OR ITS REPRESENTATIVES SHALL CREATE A WARRANTY. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BEIGE LLC, ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, AGENTS, AFFILIATES, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE OR THESE TERMS SHALL NOT EXCEED THE LESSER OF: (A) THE TOTAL AMOUNT YOU PAID TO BEIGE LLC IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).
THESE LIMITATIONS APPLY REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE) AND EVEN IF BEIGE LLC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
You agree to indemnify, defend, and hold harmless Beige LLC, its members, managers, officers, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Service; (b) your reliance on any AI-generated estimates or content; (c) your violation of these Terms; (d) your violation of any third-party rights; (e) any dispute between you and a third party (including clients, subcontractors, or project owners) arising from estimates generated using the Service; or (f) your uploaded documents or content.
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
Informal Resolution: Before filing any formal proceeding, you agree to contact us at support@fastesti.com and attempt to resolve the dispute informally for at least 30 days.
Binding Arbitration: If informal resolution fails, any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its Commercial Arbitration Rules. The arbitration shall take place in the State of Ohio. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Class Action Waiver: YOU AND BEIGE LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS AND MAY NOT PRESIDE OVER ANY FORM OF CLASS OR REPRESENTATIVE PROCEEDING.
Small Claims Exception: Notwithstanding the above, either party may bring an individual action in small claims court for disputes within the court's jurisdictional limits.
You may cancel your account at any time through your account settings or by contacting us.
We may suspend or terminate your access to the Service at any time, with or without notice, at our sole discretion, including for:
Upon termination: (a) your right to use the Service ceases immediately; (b) we may delete your data after the retention period described in our Privacy Policy; (c) all provisions that by their nature should survive termination shall survive, including Sections 7, 8, 11, 12, 13, 14, and 16.
These Terms shall be governed by and construed in accordance with the laws of the State of Ohio, United States of America, without regard to its conflict of law provisions. To the extent that arbitration does not apply, you consent to the exclusive jurisdiction and venue of the state and federal courts located in the State of Ohio.
Beige LLC shall not be liable for any failure or delay in performing its obligations under these Terms due to causes beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemic, epidemic, war, terrorism, riots, government actions, power failures, internet or telecommunications failures, cyberattacks, or third-party service provider outages (including AI providers and cloud infrastructure).
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
These Terms, together with our Privacy Policy and any other referenced policies, constitute the entire agreement between you and Beige LLC regarding the Service and supersede all prior agreements, understandings, and communications, whether written or oral.
